Since February 2025, the EU AI Act requires every company using AI to demonstrate sufficient AI literacy. Since 2 August 2026 the transparency obligations apply on top — but by no means all of them apply to you. Since 2 February 2025 you must ensure and document that your staff are trained in using AI — including ChatGPT & co.
Transparency duty in force since August 2026
Art. 50 has applied since 2 August 2026. Who it targets matters: the chatbot notice and machine-readable marking are provider duties. As a user you face paras. 3 and 4 — and you can become a provider without noticing.
Steep fines
Violations can cost up to 7% of annual turnover. SMEs face lower caps — but it still gets expensive.
