Since 2 August 2026 the transparency obligations apply on top — but by no means all of them apply to you. The AI Act’s transparency obligations are in force. Art. 50 applies — but split by role: the labelling duties fall mainly on the providers of the systems, and on you as a user only in specific cases. The high-risk obligations were deferred to 2 December 2027 by the Digital Omnibus. The Art. 4 AI literacy duty has applied unchanged since February 2025 — and that one applies to everyone.

Transparency duty in force since August 2026

Art. 50 has applied since 2 August 2026. Who it targets matters: the chatbot notice and machine-readable marking are provider duties. As a user you face paras. 3 and 4 — and you can become a provider without noticing.

Violations can cost up to 7% of annual turnover. SMEs face lower caps — but it still gets expensive.
